Terms and Conditions
These terms apply when you use encased.ai, the Encased console, API, SDKs, subscriptions and audit services. Last updated 14 October 2026.
1. Who we are
Encased is operated by Vending Machines Australia (ABN listed at vendingmachinesaustralia.com.au), Australia. Contact: get@encased.ai. By using Encased you agree to these terms. If you use it for a company, you confirm you may bind that company.
2. The service
Encased provides software that checks AI agent actions against rules, pauses risky actions for human review, and records audit trails, plus fixed-price security audits. Encased is a business (B2B) service. Read our Disclaimer for important limits.
3. Accounts and keys
- Keep your login and agent keys secret. You are responsible for all activity under them. Revoke a key straight away if it may be exposed.
- Workspace owners and admins control who is on their team and what they can do.
4. Acceptable use
You must not use Encased to break the law, attack or test systems you are not authorised to test, send content to the gateway you have no right to share, try to get around plan limits or other customers' data separation, or overload the service.
5. Plans, billing and cancellation
- Paid plans are billed monthly in US dollars in advance by Stripe, and renew automatically until cancelled.
- You can cancel at any time from your workspace billing settings. Access continues to the end of the paid period; we don't refund part-months.
- Upgrades take effect immediately and are charged the prorated difference. Downgrades apply at the next renewal.
- If a payment fails, Stripe retries it. We may limit paid features if payment is not made.
- Each plan's monthly action allowance is shown on the Pricing page.
6. Security audits
- The AI Agent Security Audit is a fixed-price service ($2,500 USD) for up to 10 agents, delivered over about 5 business days after kickoff, including a written report and a readout call.
- You must give us authorised access and accurate information. We test only systems you confirm you own or are authorised to test.
- If you cancel before work starts you get a full refund. Once work has started, refunds are at our discretion for work not yet done.
- An audit is a point-in-time review. It does not guarantee your systems are free of vulnerabilities.
7. Your data
You own the data you send to Encased. We use it only to provide, secure and improve the service, and we don't sell it. We use trusted sub-processors (such as our cloud hosting, email and payment providers). You must have the right to send any personal information you route through the gateway. You can ask us to delete your workspace data at any time.
8. Intellectual property
We own the Encased software, brand and website. The SDKs are provided under the MIT licence. You own your own rules and reports, and you give us permission to process them to run the service.
9. Availability and changes
We work to keep Encased available but do not currently guarantee uptime. We may change or discontinue features. We will give reasonable notice of material changes to these terms or prices, by email or on this page.
10. Liability
Encased is provided “as is” to the extent permitted by law. Our total liability is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, including loss caused by actions of your AI agents. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.
11. Suspension and termination
We may suspend or close accounts that break these terms or put the service or other customers at risk. You can stop using Encased at any time.
12. Governing law
These terms are governed by the laws of New South Wales Australia, and the courts of NSW have jurisdiction.
